The Jiangsu Province Data Regulations, approved by the third session of the 14th Jiangsu Provincial People's Congress on January 22, will come into force on April 1.
As the province’s first foundational legislation in the data sector, the regulations comprehensively address various aspects, including data provision and use of personal information. Notably, the regulations prohibit the repeated or redundant collection of data that can be obtained through sharing.
Jiangsu aims to construct a data security governance model characterized by coordination among the government, businesses, and other stakeholders. This model emphasizes security throughout the entire data lifecycle, encompassing supply, circulation, and utilization.
According to the regulations, data collection should be lawful and appropriate, within the prescribed purpose and scope, while avoiding excessive collection. When processing sensitive personal information, a clear and necessary purpose must be established, accompanied by robust protective measures and acquisition of individual consent. During data circulation, personal consent must be obtained legally and appropriately, and anonymization techniques must be employed to safeguard individual privacy rights.
To facilitate data trade, the regulations mandate the improvement of the trading system, strengthening the unified management of standards and platforms.
Government departments are responsible for formulating industry development plans, schemes, and incentive measures, and may establish funds to guide and support the development of the data industry.
The regulations also express support for data research and technological advancements. Jiangsu will promote the integration of data with artificial intelligence and government services, according to the regulations.
